These Terms and Conditions ("Terms") govern your use of the services provided by KhemTech Repair ("we," "us," or "our"), including our website, in-store services, and any related communications. By utilizing our mail-in repair services, you agree to be bound by these Terms.

For questions about these terms, please contact us before proceeding.

1.

Services & Authorization

Service Scope: We offer specialized repair for smartphones, tablets, laptops, game consoles, and general motherboard-level micro-soldering. Most services are performed at our Deptford, New Jersey facility.

Authorization: By submitting a device, you authorize KhemTech to perform a detailed evaluation, including disassembly and board-level inspection. You grant us permission to access, diagnose, and repair the submitted device.

Ownership Warranty: You affirm that you are the sole rightful owner of the device, or have been authorized by the owner, and that your possession of the hardware does not violate any local, state, or federal laws.

2.

Estimates & Payment

Diagnostic/Evaluation Fee: A non-refundable fee of $50.00 (plus applicable sales tax) applies to all devices. This fee covers the technician labor required for assessment and providing a quote. If you proceed with the quoted repair, this amount will be credited towards your final invoice.

Dynamic Quotes: Initial estimates are based on our first assessment. If additional faults are discovered during the repair, we will pause and provide an updated estimate. No work beyond the original scope will proceed without your verbal or written approval.

Updated Quotes: If secondary faults are discovered requiring a revised quote significantly higher than the original estimate, the Client may elect to decline the additional work. In such cases, the original Diagnostic Fee remains due, and KhemTech reserves the right to charge for labor and consumables already invested up to that point before the device is returned.

Payment Terms: Payment for successful repairs is due upon completion. For unsuccessful repair attempts, the Diagnostic Fee remains due prior to the return of the device.

3.

Data Integrity & Recovery

Client Responsibility: You are solely responsible for backing up your data prior to service. KhemTech does not guarantee data integrity and is not liable for any data loss, corruption, or hardware failure during the repair process..

Data Recovery: You acknowledge that data recovery is a specialized and often destructive process. To extract data, storage media may be rendered permanently inoperative and will not be returned in working condition.

4.

Limited Warranty

We provide a 30-day warranty on the functionality of all repairs and/or parts replaced.

Coverage: If the original issue recurs within 30 days, we will perform the service again at no extra charge. This covers both our labor and the parts supplied, if applicable.

Exclusions: This warranty is void if the device shows signs of physical damage, liquid exposure, or if the internal KhemTech warranty seal is broken. We do not offer warranties on software, virus removals, or customer-provided parts. ANY physical damage to a device repaired can result in the warranty being void.

LCD Replaced (if applicable): You acknowledge that glass does not crack spontaneously; a crack is the result of physical stress or impact. Consequently, any crack, chip, or break in the glass or LCD after the device has been returned to you voids the warranty immediately. This especially applies to MacBook screens as drop-damage can result in internal cracking of the internal LCD/OLED panel and voids warranties.

Warranty Claims: To claim warranty service, the device must be returned to KhemTech with proof of purchase. No refunds will be issued until KhemTech has been granted the opportunity to rectify the original issue.

5.

Repair Risks

Electronic repairs are unpredictable. By sending your device to KhemTech, you acknowledge the these inherent risks:

Existing Damage: Components - especially on liquid-damaged devices - can fail without warning during repair. KhemTech is not liable if a device is rendered permanently unusable during a repair attempt.

Glued-on Screens: Devices like iPads or iPhones require prying the glass to access internal parts. While we are highly experienced and use precision tools, these screens are delicate and can crack. We do our best to avoid this, but the risk of breakage exists.

Water resistance: Once a device is opened for service, the original factory seal is compromised. While KhemTech utilizes high-quality replacement adhesives to restore as much protection as possible, we cannot guarantee any level of water resistance post-repair. The device should no longer be considered waterproof or water-resistant.

In the Event of a Break: If a screen cracks during the necessary disassembly process, KhemTech will notify you immediately. Because this is an inherent risk of the device's design, KhemTech is not liable for the cost of a full retail replacement. However, we will offer to replace the damaged screen at our wholesale part cost with no additional labor fee for the screen installation itself.

Component Failure: Proprietary features like Appleʼs Face ID or Touch ID, or integrated GPUs on older laptops (MacBooks, HP, Dell, etc.), are prone to failure and may become unusable during or after a repair due to pre-existing stress.

6.

Communication

By providing your contact information, you consent to receive updates regarding your repair status and reminders via SMS and email.

  • Opt-Out: You may opt out of promotional messages at any time.
  • Privacy: We will not share your mobile number or email with third parties for marketing purposes.
7.

Shipping, Logistics & Abandoned Property

Return Shipping: Devices sent in generic packaging will be returned in similar packaging at the customerʼs risk.

Transit Liability: KhemTech is not liable for devices lost or damaged by third-party carriers. We strongly recommend the purchase of full-value shipping insurance.

Damage Notification: KhemTech will notify you of any transit damage discovered upon unboxing within 24-48 hours of receipt.

Abandoned Property: Invoices are subject to 30-day payment terms. Equipment remaining unpaid or uncollected for 60 days following notice of completion shall be deemed legally abandoned. KhemTech reserves the right to sell or recycle abandoned property to recoup costs.

Insurance Coverage: For return shipping, KhemTech will apply insurance coverage based on the value declared by the customer on the intake form. The cost of this insurance will be added to the final invoice. If no value is declared, KhemTech will ship the device with the carrier's standard minimum coverage (typically $100). The customer acknowledges that KhemTech is not an insurance provider; any claims for lost or damaged shipments must be filed with the carrier.

8.

Legal Protections

To the fullest extent permitted by applicable law, our liability for any damages arising out of or relating to our services is limited to the amount you paid for the repair. We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost data, or loss of use of your device.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Indemnification: You agree to indemnify and hold KhemTech Repair harmless from any claims, damages, or legal expenses arising from your breach of these Terms or third-party claims related to the device.

Limitation of Liability: To the maximum extent permitted by law, KhemTechʼs total liability for any claim shall not exceed the amount paid for the service.

Choice of Law & Venue: These Terms are governed by the laws of the State of New Jersey. Any legal disputes shall be adjudicated exclusively in the courts of Gloucester County, New Jersey.
